the main failure of your X, and the reason I predict her move will be denied, is that she has not established she is the CP. The court hasn't made that determination, and neither is she de facto (although she will argue she is, and you just deny it). The second most important reason she will be denied is because her move request isn't based on sound reason. She doen'st have any job lined up, that just don't fly in court. The third thing is that she is being spiteful, and that any claim to greater timeshare does not make her de facto CP, because she is going out of her way to prevent you from more time. Your defense is you are ready, willing and able to be the CP, she just won't allow it. Keep sending those certified letters asking for more time, explaining that you are home all day, and you want to care for the child.

I am willing to bet that the judge doesn't allow her to take more than 50% of the kid out of state. Before that happens though, you will sweat bricks, and cough up lots of $$$$$. Whatever, don't drop your guard. fight for primary, settle for neither parent primary. Good Luck., Keep us posted. You are going to trial, and this will take months to play out.
