question about smoking

I have a question about a stipulation in my husband's parenting plan...

This past weekend, my SD made mention to my husband and me about how she'll never smoke cigarettes when she's a grown up, and things she'll say to her own children if they ever start smoking, etc. She's 6. She made mention of how her mom is "constantly smoking", how much she hates the smell, and that she keeps telling her mom to stop.

Anyway, my husband asked her if her mom smokes around her and she said all the time, especially in the car. He asked if she could smell the smoke when they were in the car and she said yes. We do know she does not smoke in the house, she always smokes on her balcony.

In thier parenting plan their is a line that reads, "Both parents agree to not smoke in the presence of the minor child or allow anyone else to do so because of the general danger associated with second hand smoke."

We do not care if BM smokes. We DO care that she is subjecting SD to second hand smoke. Is there anything we can do about this? Even a scare tactic? We just want her to know we're serious about this and would like her to stop smoking around SD. Is there any way to enforce this stipulation?
