I do not mean to question your legal knowledge...
But, are you certain about this?

If true, than why would there be a stipulation in settlements stating that both parties have rights to those records?
Schools state that, barring court order to the contrary, they only have responsibility to the custodial parent. (This one I know because my kids school tried to pull that one on me.)
As for legal custody, if the issue is unresolved what happens when a decision involving legal custody has to be made? (I know... probably chaos...).
Would there be any truth to the premise that (technically speaking) an NCP has their parental rights terminated and then partially reinstated?
