I think you've hit the nail squarely: There is bias in the system ... legally sanctioned bias ... for CPs.

I believe the correct line of attack is that this distinction (CP and NCP) when made pursuant to anything other than voluntary agreement from the NCP or misbehavior of the NCP, is simply indefensible because what it does is by operation of law it infringes a parent's fundamental rights. I think it's a powerful argument that sets up various other powerful arguments. My team has gamed this things six ways from Sunday and we continue to grow more optimistic about our chances.
