I don't know for sure, but what does the court paperwork say in regards to that issue? Lately I know I've heard about right to first refusal for parents where if one parent does not have the child the other has the first option of the child being with them. I'm not sure, I'm no expert, but it may be something to look into. But if they do have shared maybe the paperwork already has something. I know with right to first refusal BM and I have no paper work regarding that but I abide by it anyway as it seems to be what is best for our daughter.
