BIC eliminates any arguement against the judges discretionary authority. The New Mexico law 40-10A-307a specifically states a judge is not permitted to use disctretion and they do it any way and state on the record "I do not like that law so i'm going to do it my way". Ignoring the very specific wording of their own state laws, the mandates of the UCCJEA,PKPA United States Supreme Court Rulings. BIC is the catch all and they do as they please for profit because of it.
Take BIC out of the law and most of the judges would have to go back to law school where they might even be required to read the U.S. Constitution. Children have rights, the right to be protected and provided for by their parents.
