In the state In live in you have to go through teh courts so check it out for your state. Have you talked to the father about this? Also remember your child is only 8 months. If you move him now it will be very hard to the child and the father to have a close relationship. but that doesn't not mean that they still couldn't have one liveing that far away. also if he is seeing his son on vistitation . am sure he will put up a fright.
