Well, life has been busy since winning custody! But after all of it I still have a question. We are now re-working CS, as BM never reported that she was now full time and not part time. They asked us to submit paystebs, last years w-2, ect. Well, I submitted everything, and she submitted nothing, so they asked her work for her W-2 from last year and used it. Problem is, until November of last year she only worked 2 days a week, if that much. Now she is the only worker and moneymaker in the home, and they kept her at 12,000 for the year. Well, I'm not sure whether to fight this or not, but I want to just to see her exposed (I know it's petty, but unfortunately true). Here is the thing. I know that if I had her bank statements I could prove she makes more than 1000 per month, as she deposits more than that per month, and only buys gas and groceries with cash (She is a waitress)But if I brought this before the court, I'd probably be charged with how I know this. Can I subpoena this info? Her husband does not have a job and has not since December 05. So all money would come from her. Is there any way to get this info before a judge and prove her lying to not only CSEA but also on her taxes. Also, would it be worth it? CS is super low with her only making 12,000 last year, but that was working 2 days a week and now she works 5-7 days each week. I think it would make a difference big time, but is it worth it? No matter what she won't pay, as she already doesn't, and I can deal with that. But I would at least like to require her to "support" her daughter with the full amount she makes at least on the paperwork. any thoughts?
