My husband has an 8 year old son who he pays child support for, but lives in another state. The childs mother has recently found out she is quite sick, and truthfully,we are not sure how long she will be around. She has never been cooperative concerning visitation, nor has she ever really told the child that his bio father is NOT her husband. They have talked about her husband adopting him, but have not wanted to lose the child support.
My question is, if the situation arises where she is no longer living due to her illness, would the child be able to come to us, since my husband is his BIO father? He has never relinquished rights to the child, and we have a very stable environment in which to raise him. We are concerned that her parents or her husband would assume they have rights to the child over my husband, and are wondering what we can do.
