why not just hand the money back to him each month that you plan to not accept payment. It would be alot easier for everyone involved if you do it that way instead of bringing it before a judge - especially since all you want is a temporary order. Also why pay an attorney for an agreement you and you ex are perfectly capable of handling yourself.
