Like HRUs said, the 4 hour distance makes enforcing a ROFR very difficult in our case. The situation you offered comes up every summer. We split the summer and during the CP's portion, she sends the child to FL to be with extended family for almost her entire portion of the break. We are available to take SD, but since it is CP's time, she can do with it whatever she'd like.
