A lawyer specializing in that jurisdiction has already said the law allows them to move w/out interruption..
All that's left to be determined is how much or how little time the NCP left behind gets.. I doubt it would be too difficult for sally's dh to end up with the standard minimum visitation long distance parenting plan.. but rather than giving other options all I see anyone here doing is drawing a line in the sand: Stay and that's the only option.
Frankly it's the least likely outcome and everyone can plainly see this. Sally and her dh are more than likely going to move. Should they be encouraged to leave the mother with minumum visitation or to offer as much as they possibly can?
Which would you like for them to offer if you were the NCP on the receiving end of this situation? I know what I would choose.
These kids already have friedns and relationships built in the community where their mother is remaining.. they can play little league there w/ her and winter basket ball when w/ their dad.
The schedule we use only requires 26 round trips for the kids per year.. standard minimum eow etc will require 78.. over 10,000 miles more per year.
