Lawmoe, my stance is this: She might win, she might not. Kind of hard to prove me wrong on both counts no matter what transpires. On the other hand if the move-away is not forthcoming, you would look pretty stupid with your "virtually certain" comment.

You are confusing "preference" with certainty, even though you know that some move-away attempts are blocked. For your boast of certainty to be more than hot air, you would have to show that in-state move-aways have NEVER been blocked. lol.

You are trying to act as if the state line is all that matters, even though that law is not even in effect yet, so the state line is irrelevent. If the only thing that mattered was the state line, then there would not be a long list of factors that judges are required by MN law to consider in move-away cases. If it were always a simple matter of checking the map for an imaginary line, there would be no need of a judge...

...or a lawyer.

It bothers me that you are using this website to gain business for yourself. I wouldn't really care if it weren't for the fact that you are over-stating her chances of winning for your own benefit, while others may be misled reading this, unaware of your motives.

Judges HATE move-aways and they know they are a severe detriment to the kids involved. The main reason most move-aways are approved, however, is that the judge just can't see fit to change custody to the NCP, especially if there is gender bias in play. Despite the overall reluctance to change custody in family court (in any circumstance, not just move-aways) a suprising number of move-aways are blocked, and the numbers are rising.

There isn't enough information here so I really don't have any idea whether sally will be one of the lucky ones.

And neither do you.
