I present this scenario for discussion. Custodial mother makes well over $100,000.00 a year and is very well off. NC father is unemployed and behind in CS. Custodial mother uses this as a lever to keep the father from seeing his child. Basically if he wants to see the child she threatens him by saying she will have him incarcerated. How is it and why is she able to use the welfare laws to her advantage when she is obviously not even close to being a candidate for welfare. As an added note she has had him incarcerated in the past during a period of unemployment for him. The custodial mother justifies this to the child by telling the child that the father is a bad person because he is behind in CS and is in violation of the law. The CP and the NCP have been in court over a half dozen times over the years in custody battles with the NCP loosing ground each time despite the recommendations of court appointed CFI's.
