What I refer to is that the courts can incarcerate and have in this case the NCP under welfare reform act title 42/7/IV-D/666. The NCP has gone to court on his own to have a modification in CS and the court would not grant a modification. The CP mother is far from being on welfare. NCP has gone to court several times to enforce time but the courts have never acted against CP other than telling her not to do it anymore then promptly (the last time) put the NCP in jail for 30 days for being in arrears. Of course parenting time is not supposed to have anything to do with CS-but I think most judges view them as interconnected. I have personnally not heard of any cases where the NCP has been able to achieve a modification to more time when they are in arrears on CS.
