I had to get a bit of clearification. NCP has been incarcerated twice. first time he was behind less than $2000 (3 months)during a period of unemployment. The strange thing is that the CP had funds from the sale of community property that she was to pay him but did not. Judge called him a deadbeat and sentenced him to 30 days (the day after his incarceration she turned the monies over less the arrears in CS). The NCP works in the construction trade and has periods of unemployment between projects. The NCP pays the CS when employed. My question is that why is this CP able to use welfare laws for the collection of the CS when she obviously makes a very good living and is not on welfare and why does the court allow (and it seems to encourage) her to use the threat of incarceration to withhold time? Second time he was incarcerated was for 4 months arrearages, again during a period of unemployment. The more that comes to the surface on this situation, I see the CP as having some real issues hanging over from the union that she will not let go of.
