Extra Child support payments

On April 20, my husband terminated his rights. At that point, he was $800+- behind. The guardian ad litum had to redraft the paperwork to show that he had joint custody at the time of the termination (JUst something the judge did to get around a previous ruling). He still has not done it. It has to be done by him, and then passed around to all parties to sign and then back to the judge. After figuring up current, by now he has paid arrearages, and then next week it will be above and beyond. His lawyer didn't tell him he would have to file his own motion. Which he did a month ago. DCSE said they do not make refunds, and won't stop taking payments until they see a court order. Which is understandable. They said he would have to sue her for any extra money she recieves. Does anyone have any advice on how to go about stopping this? Will a judge in civil court actually make her pay back extra money she recieves??
