What you are asking for certainly seems reasonable considering the circumstances. If you were asking to be primary with a more limited shared schedule I might be more pesimistic.
Hopefully they will just offer next week to make your residence the residence that determines the school.
If not, I will hope with you that all goes your way in court :)
