With split custody and the child being 12

I would think that the wishes of the child would way heavily in the final decision.

Maybe you can make a good offer to Mom that makes her time share large enough and often enough that she would agree.

Also offer to write off any child support in time share and travel expenses and you might end up saving yourself $20,000 in lawyer fees.

How far are you moving? Does your son have 1/2 siblings that live with mom?
