at age 12 a child's preference is taken into account by the court if the issue is brought before the court. There still must be a material change in circumstances for the change to occur.
Just because mom is strict, or did not by the oreo's does not meet the standard. However, significant behavioral problems, neglect, etc can be in conjunction with the childs preference.
