Sorry to be pessimistic. It is extremely unlikely that a CA court is going to give you custody at all, but especially since your intention is to do to the mom exactly what she has done to you. The child is established with the mom at this point, unless she's abandoned him or has abused him, she is the primary parent and basically the only parent the child really knows at this point.
