I understand what you mean about BIC. If a judge can't come up with any other reason to do nothing they site BIC.
But, what's the alternative basis to judge a family law situation by? It used to be custody of children followed property laws. That doesn't seem the best standard either.
Fathers used to automatically own children as a matter of property (wives were property also), then the tender years doctrine came to be for a while.
