search "child custody" and "dependency" to get cases that may be of use to you. Note the court cases referenced in the opinions and read those also.
If you really think the child is in danger because of the mother's drug use, I would consider talking to child protection services. When they get involved children can be placed with the other parent through dependency procedures.
