My X filed fopr custody in CA 6 weeks after I had taken the kids for summer visitation that was not court ordered, but she met me at a neutral place with witnesses for me to pick up the kids and take them for the summer. That was the plan until the children started telling stories of abuse.
I am not going to say if either party is right. You just think about it.
My three oldest in this custody case both tell of abuse at the hands of their mother's boyfriend towards the 2 boys. The stories are told the same from all children, and were not told in front of eachother. So the other is not hearing what the other said. I let them talk to me when ever they want. One of the boys. is also having a hard time sleeping at night. I've asked him why and his answer is "I'm scared that my mom is getting hurt" or "I keep having dreams that "mom's boyfriend" is going to get me. He tells us my fiance and I that he has seen his mom's boyfriend and his Mom "Hitting" each other. My six year old daughter has also told stories of the same.
The kids are much happier now. They all want to live with me and my fiance. Their school work is improved greatly, and has their behavior. My nine year old boy now loves to give hugs and lots of "Love yous". My 10 year old is in the top of his class now. My six year old can read all most anything you put in front of her if you give her a little time. All the kids want is to be safe from abuse, and they deserve it. Their Mother has even charged and convicted of WILLFULL CRUELTY TO CHILD/POSS INJURY OR DEATH, for which she had to serve 275 days in jail and is still on probation for at this time. She has violated 2 times since then and from what I've been told spent time in jail last year as well. She was collecting state assistance for all the children up until DEC 7th when I got them JUN 23rd.
Since the kids have been with us they have done things that they had never done. Such as: camping, hiking, fishing, boating going to a lake, to the beach as well as many other thiings that they have never expirienced.
I also have a 5 year old daughter that I have full and sole coustdy of. This child knows my fiance as her mother.
Now the motherof the 3 older children is fighting me for the kids and taking me to court. I have been handling most of this on the phone, mail, and fax.
But now the Courts are demanding that I be in court Jan 16th and Jan 25th in southern california. The judge even threatened me and told me that if I was not in court and if I did not have the children there that he would turn the case over to the DA's office as a child abduction case. Sounds to me like this judge already has his mind made up. Now my questions to all of you out there is: Is this even legal? Can this judge demand the appearance of me and the children even though we live so far away? Can the judge threaten me like that?
It gets even better. I live in washington state. This area has been labled as a disaster area by the Great Mr. Bush. I have sufferd great financial loss. I have to move my family from this house because the roof is in bad shape. We were out of power for 5 days. In this time all our food went bad. I hade to resupply the house hold. I just got a job in Seattle. But I have to travel for work. So all of this has put a strain on our $$$$$. We now have food water and power, so it could be worse.
So because of all of this I cant aford legal help on my own. I'm also going to have to get lodging for me and my family (6 total). So if any of you out there got any info that you think that I might need PLEASE SEND IT TO ME. Cause these kids need to stay with us.
